1. Introduction
Welcome to Fly&Health. The website at flyandhealth.com, together with the patient application at app.flyandhealth.com and the healthcare provider portal at doctors.flyandhealth.com (collectively, the "Platform"), is owned and operated by Fly&Health Limited, a company registered in England and Wales, with its registered office at York House, 18 York Road, Maidenhead, United Kingdom SL6 1SF ("Fly&Health", "we", "us", "our").
By accessing or using the Platform, you agree to be bound by these Terms of Use. If you do not agree, you must not use the Platform.
These terms apply to patients and visitors. If you are a healthcare provider, please refer to the Healthcare Provider Terms of Use.
2. Definitions
- "Healthcare Provider" means any doctor, clinic, or hospital registered on the Platform to receive patient enquiries.
- "Patient" or "You" means any individual who submits a treatment request or uses the Platform to find healthcare services.
- "Services" means the medical, dental, aesthetic, ophthalmic, orthopaedic, or other healthcare services offered by Healthcare Providers.
- "Platform Services" means the technology services provided by Fly&Health, including the ability to submit treatment requests, browse Healthcare Provider profiles, and facilitate communication between Patients and Healthcare Providers.
3. Nature of the Platform
Fly&Health is a technology platform that facilitates introductions between Patients and independent Healthcare Providers. It is important that you understand the following:
- Fly&Health is not a healthcare provider, medical referral service, or medical tourism facilitator. We do not provide medical advice, diagnosis, or treatment of any kind.
- Fly&Health does not employ, represent, or act as agent for any Healthcare Provider listed on the Platform. All Healthcare Providers are independent third parties.
- Fly&Health is not involved in any transaction, agreement, or arrangement between you and any Healthcare Provider. The responsibility for consultations, appointments, treatment delivery, and outcomes lies solely with the relevant Healthcare Provider.
- Fly&Health does not endorse, recommend, or guarantee any particular Healthcare Provider. The appearance of a Healthcare Provider on the Platform, or their position in any listing or search result, does not constitute an endorsement, recommendation, or comparative ranking.
- While we require Healthcare Providers to submit credentials for verification before accessing the Platform, we do not independently audit clinical competence, treatment outcomes, or ongoing compliance with medical regulations. Our verification process is an administrative check of submitted documentation and should not be relied upon as a guarantee of quality or suitability.
4. Platform Services We Provide
- Fly&Health enables Patients to submit treatment requests describing the healthcare services they are seeking, including treatment category, medical details, budget, and preferred timing.
- Fly&Health enables verified Healthcare Providers to browse anonymised Patient treatment requests that match their registered specialities.
- When a Healthcare Provider expresses interest in a Patient's request, the Patient is notified and the Healthcare Provider receives the Patient's contact details to facilitate direct communication.
- Fly&Health may send transactional emails to Patients and Healthcare Providers to facilitate the above processes, including request confirmations, interest notifications, and account-related communications.
5. Services We Do Not Provide
- We do not provide medical advice, diagnosis, treatment, or second opinions. All information on the Platform is for general informational purposes only and should not be treated as a substitute for professional medical advice.
- We do not manage, coordinate, or oversee any aspect of the medical services provided by Healthcare Providers, including appointments, travel, accommodation, procedures, or aftercare.
- We do not guarantee or verify the accuracy, completeness, or currency of any information provided by Healthcare Providers on the Platform.
- We do not mediate disputes between Patients and Healthcare Providers. Any disagreement regarding Services must be resolved directly between the parties involved.
6. Your Responsibilities as a Patient
- You warrant that all information you submit through the Platform is accurate, truthful, and up to date. You must not submit false, misleading, or fraudulent treatment requests.
- You acknowledge that if you choose to engage a Healthcare Provider through the Platform, you do so at your own risk and on your own judgement. We strongly recommend that you undertake your own research into any Healthcare Provider and consult with your own doctor or primary healthcare provider before proceeding with any treatment.
- You acknowledge that certain Healthcare Providers may be located in jurisdictions where insurance, accreditation, or regulatory requirements differ from those in your home country. You are solely responsible for assessing these factors.
- You must be at least eighteen (18) years of age to use the Platform. By using the Platform, you confirm that you meet this requirement.
- You must not use the Platform for any unlawful purpose, to harass or harm any person, or to submit spam, fraudulent, or misleading content.
7. Data Protection
- We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Full details are set out in our Privacy Policy, which forms part of these Terms of Use.
- By submitting a treatment request, you explicitly consent to your contact details and medical information being shared with Healthcare Providers who express interest in your case. You will be notified each time your details are shared.
- Your contact details are never displayed publicly on the Platform. They are only shared with specific Healthcare Providers in the manner described above.
- You may withdraw your consent and request deletion of your data at any time by contacting us at privacy@flyandhealth.com.
8. Intellectual Property
- All content, design, graphics, logos, trademarks, text, software, and other materials on the Platform are the property of Fly&Health Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws.
- You may not copy, reproduce, modify, distribute, republish, or create derivative works from any content on the Platform without our prior written consent.
- By submitting content to the Platform (including treatment requests, reviews, or photos), you grant Fly&Health a non-exclusive, royalty-free, worldwide licence to use, display, and process that content for the purposes of operating the Platform.
9. Disclaimers
- The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Fly&Health makes no representations or warranties of any kind, whether express or implied, regarding the Platform, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement.
- All information provided on the Platform, including information about Healthcare Providers, treatments, and indicative pricing, is intended as a general guide only. It should not be relied upon as medical advice or as a guarantee of availability, pricing, or outcomes.
- Fly&Health does not guarantee that the Platform will be available at all times, uninterrupted, error-free, or free from viruses or other harmful components.
- Fly&Health assumes no responsibility for the safety, quality, legality, or suitability of any Services provided by Healthcare Providers, or for the accuracy of any information they provide on the Platform.
10. Limitation of Liability
- To the fullest extent permitted by applicable law, Fly&Health, its officers, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, your engagement with any Healthcare Provider, or any Services received through the Platform.
- This includes, without limitation, damages for loss of data, loss of income, loss of opportunity, personal injury, or any other losses, even if Fly&Health has been advised of the possibility of such damages.
- Nothing in these Terms of Use excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
11. Indemnity
You agree to indemnify, defend, and hold harmless Fly&Health and its officers, directors, employees, and affiliates from and against any claims, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your breach of these Terms of Use, or your engagement with any Healthcare Provider.
12. Suspension and Termination
Fly&Health may, at its sole discretion and without prior notice, suspend or terminate your access to the Platform for any reason, including if you have provided false or misleading information, breached these Terms of Use, or if we are unable to verify your identity. We shall not be liable to you or any third party for any such suspension or termination.
13. Third-Party Links
The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of any third-party websites. A link to a third-party website does not constitute an endorsement by Fly&Health.
14. Amendments
Fly&Health reserves the right to modify these Terms of Use at any time. Changes will be posted on this page with an updated "last updated" date. Your continued use of the Platform following any changes constitutes your acceptance of the revised terms.
15. Governing Law and Jurisdiction
- These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales.
- Any disputes arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- The language of any dispute resolution proceedings shall be English.
16. Severability
If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Fly&Health regarding your use of the Platform and supersede all prior agreements and understandings.
